Ventura County Paternity Lawyers
Experienced Paternity Attorneys Helping Parents Legally Establish the Father of a Child
Please know that there are several types of legal presumptions involving married and/or unmarried parties which may have a significant effect on the paternity of a child. A DNA test and/or who is on the birth certificate does not always in and of itself determine paternity. Some legal presumptions will undoubtedly really surprise you and could change the outcome of who is adjudicated as the father. As one example, if a child is born outside of a marriage and the male in the relationship does things such as, but not limited to, accepting the child into his home, treats the child as his own, supports the child, holds the child out to be his own, he can become the child’s “natural child” regardless of DNA testing proving he is not the biological father.

What is Paternity?
A Paternity action arises when the parties are not married, and a child is born. In that case, there is no presumption that the male in the relationship is the father. This is unlike a child that is born during a marriage where there is a presumption that the husband is the father.
To start a Paternity action, one of the parties must file a Petition to Establish Parental Relationship with the court and the other party must be personally served. The other party should file a response. If either party questions paternity, a DNA test can be requested.
