What is Paternity?

A Paternity action arises when the parties are not married, and a child is born. In that case, there is no presumption that the male in the relationship is the father. This is unlike a child that is born during a marriage where there is a presumption that the husband is the father.

To start a Paternity action, one of the parties must file a Petition to Establish Parental Relationship with the court and the other party must be personally served. The other party should file a response. If either party questions paternity, a DNA test can be requested.
